Welcome to SchoolGPT! By accessing or using our website, mobile application, or any of our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all visitors, users, and others who access or use SchoolGPT. By using our Service, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

2. Description of Service

SchoolGPT is an AI-powered teaching assistant designed specifically for K-12 educators. Our Service provides:

  • AI-powered tools for lesson planning, grading, and communication
  • Pre-built templates for common teaching tasks
  • Chat interface for custom AI assistance
  • Resource library for saving and organizing generated content
  • Multiple AI model options for different needs

3. Account Registration

To use certain features of SchoolGPT, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree to use SchoolGPT only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Input student personally identifiable information (PII) into the system. This includes but is not limited to: student names, grades, test scores, behavioral records, health information, disability status, disciplinary records, or any other data that could identify a specific student. You are solely responsible for ensuring compliance with this requirement.
  • Attempt to bypass usage limits or security measures
  • Share your account credentials with others
  • Use the Service to generate harmful, discriminatory, or inappropriate content
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools to scrape or extract data from the Service
  • Resell, redistribute, or commercially exploit the Service without authorization
  • Interfere with or disrupt the Service or servers connected to the Service

We reserve the right to investigate violations of these Terms and take appropriate action, including suspending or terminating your access to the Service.

5. Educational Privacy Compliance

SchoolGPT is designed to support compliance with educational privacy laws:

FERPA (Family Educational Rights and Privacy Act)

SchoolGPT does not require the input of student education records. By using our Service, you agree not to input any information that constitutes a student education record under FERPA. If you are using SchoolGPT on behalf of a school or district, you represent that your use complies with your institution's FERPA obligations.

COPPA (Children's Online Privacy Protection Act)

SchoolGPT is designed for use by adult educators only. By creating an account, you confirm that you are at least 18 years of age. SchoolGPT does not offer accounts to students or children, and we do not knowingly collect personal information from children under 13.

School & District Use

Schools and districts may request a Data Processing Agreement (DPA) by contacting support@schoolgpt.app. We are committed to working with educational institutions to ensure our Service meets their compliance requirements.

6. AI-Generated Content

Ownership

Content you generate using SchoolGPT (lesson plans, rubrics, feedback, etc.) is yours to use for your educational purposes. You retain ownership of your inputs and the outputs generated from them.

Accuracy & Review

AI-generated content is provided as a starting point and may contain errors, inaccuracies, or outdated information. You are responsible for:

  • Reviewing all AI-generated content before use
  • Verifying accuracy and appropriateness for your students
  • Ensuring alignment with your curriculum and standards
  • Making any necessary modifications or corrections

No Warranty

We do not guarantee that AI-generated content will be error-free, suitable for any particular purpose, or meet your specific requirements. SchoolGPT is a productivity tool to assist educators, not a replacement for professional judgment.

7. Intellectual Property

Our Property

The Service, including its original content, features, functionality, design, and branding, is owned by SchoolGPT and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without express written permission.

Your Content

You retain ownership of any content you submit to SchoolGPT (e.g., lesson topics, rubric criteria, student work samples). By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you.

8. Privacy

Your use of SchoolGPT is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

9. Third-Party Services

SchoolGPT integrates with third-party services (AI providers, authentication services, file storage) to deliver our Service. We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk.

We may provide links to external websites for your convenience. We do not endorse or assume responsibility for the content or practices of any linked third-party sites.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of AI-generated content

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCHOOLGPT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Cost of substitute services
  • Any damages arising from your use of AI-generated content

In no event shall our total liability exceed the amount you paid to SchoolGPT in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless SchoolGPT and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in the United States.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SchoolGPT regarding your use of the Service and supersede all prior agreements and understandings.
